TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern all access to and use of the Comic Forge website ("the Site") and all purchases, memberships and services ("Services") offered by Comic Forge ("we", "us", "our").

• By using the Site or placing an order, you confirm that you are at least 18 years of age, or have obtained verifiable parental or guardian consent.
• You confirm that all information you provide to us is true, accurate and complete.
• We reserve the right to update or amend these Terms at any time without prior notice. The date of the latest revision is shown at the top of this page. Continued use of the Site following any changes constitutes your acceptance of the revised Terms.
• These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and the Protection of Personal Information Act 4 of 2013.

Product Accuracy

All products are 3D printed and handcrafted. Minor variations in colour, texture and finish may occur between batches — this is inherent to the manufacturing process and does not constitute a defect.

Order Acceptance

• Placing an order constitutes an offer to purchase, not a confirmed sale. A binding contract is only formed once we send an order confirmation email.
• We reserve the right to refuse, cancel or limit any order at our discretion, including but not limited to orders that appear fraudulent, abusive or in violation of these Terms.
• If we cancel an order after payment has been received, a full refund will be issued within 5 business days.
• Pricing errors: if a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the order and issue a refund, even after an order confirmation has been sent.

Custom Orders

• All custom orders require written quote approval via email before production begins. Verbal agreements are not binding.
• Once a custom order enters production (confirmed via email), cancellations are not accepted and no refund will be issued.
• We will not produce custom orders that infringe on third-party intellectual property, contain offensive, hateful or illegal content, or violate any South African law.
• Files submitted for custom printing must be owned by you or you must have the legal right to use them. By submitting a file you warrant this is the case and indemnify Comic Forge against any related claims.

All transactions are processed in South African Rand (ZAR) via our secure third-party payment providers (PayFast, Yoco). Comic Forge does not store, process or have access to your card or banking details.

• Full payment is required before any order is processed or dispatched.
• Chargebacks and payment reversals initiated without first contacting us to resolve the issue will be treated as fraud and reported to the relevant authorities and payment processors.
• Comic Forge reserves the right to pursue legal action and recover costs, including legal fees, for fraudulent chargebacks or payment disputes made in bad faith.
• If a chargeback is initiated, we reserve the right to immediately suspend your account, cancel any pending orders and report the incident to SAPS and our payment processor's fraud division.
• We use fraud detection systems. Orders flagged as potentially fraudulent may be held for verification. We may request proof of identity or payment authorisation before processing.
• Any attempt to use stolen, cloned or unauthorised payment methods is a criminal offence under South African law and will be reported to law enforcement.
• Promotional codes and discounts may not be combined unless explicitly stated. Abuse of promotional codes (including creating multiple accounts to redeem the same offer) will result in order cancellation and account suspension.

• Standard orders are dispatched within 48 hours of confirmed payment. Custom orders ship within 3–5 business days of production approval.
• Delivery timeframes are estimates only. Comic Forge is not liable for delays caused by courier services, weather, industrial action, public holidays or any other circumstances beyond our reasonable control.
• Risk of loss and title transfers to you at the point of handover to the courier.
• You are responsible for providing a complete, accurate delivery address. Comic Forge accepts no liability for non-delivery or misdelivery caused by an incorrect address provided by you.
• If a parcel is returned to us as undeliverable due to an incorrect address or failure to collect, re-delivery costs are at your expense.
• If a package is marked as delivered but not received, you must notify us within 48 hours. Claims made after this window may not be accepted.
• Comic Forge is not responsible for packages lost or stolen after confirmed delivery to the provided address.
• Free shipping applies to orders over R900 within South Africa. International shipping rates apply to orders outside South Africa.

In accordance with the Consumer Protection Act 68 of 2008, you may return physical goods within 5 business days of receipt if they are defective, damaged in transit or materially different from what was ordered.

Eligible for Return

• Items that arrive damaged or defective — photographic evidence required within 24 hours of receipt.
• Items that are materially and significantly different from the product description.
• Incorrect items sent in error.

Not Eligible for Return

• Custom-printed items that were produced to your approved specification.
• Digital downloads once accessed, downloaded or the download link has been opened.
• Items showing signs of use, modification, damage caused by the customer, or normal wear and tear.
• Items returned after the 5 business day window without prior written authorisation from us.
• Change-of-mind returns are at our sole discretion and are not guaranteed.

Return Process

• All returns must be pre-authorised — contact support@comicforge.co.za before returning any item.
• Unauthorised returns will not be accepted and will be returned to sender at their expense.
• Items must be returned in their original condition and packaging.
• Return shipping costs are the responsibility of the customer unless the return is due to our error.
• Approved refunds will be processed within 7 business days of receipt and inspection of the returned item.

All STL files and digital products sold by Comic Forge are licensed, not sold. Purchase grants you a limited, non-exclusive, non-transferable personal use licence subject to the following:

• Permitted: Printing for personal, non-commercial use. Printing as gifts for individuals (not for resale).
• Not Permitted: Redistribution, resale, sharing, uploading to file-sharing platforms, or any form of commercial exploitation without a separate written commercial licence from Comic Forge.
• Reverse engineering, modifying or creating derivative works from our files for commercial purposes is strictly prohibited.
• Digital downloads are non-refundable once the download link has been accessed or the file downloaded, regardless of circumstance.
• We track download activity including IP addresses and timestamps. Misuse of download links will result in licence termination and potential legal action.
• Sharing your download link with others is a breach of this licence and constitutes copyright infringement under the Copyright Act 98 of 1978.

• Memberships are billed monthly in advance and renew automatically on the same date each month until cancelled.
• You may cancel at any time via your account page. Cancellation takes effect at the end of the current billing cycle — no partial refunds are issued for unused days.
• If a monthly payment fails, your membership will be suspended until payment is received. Access to member benefits and new file drops will be paused during suspension.
• Creating multiple accounts to exploit free trials or introductory offers is prohibited and will result in permanent account bans across all associated email addresses and devices.
• Member discounts apply only to orders placed while your membership is active. Discounts cannot be applied retroactively.
• Membership benefits (file quantities, discount percentages) may change with 30 days written notice. You may cancel without penalty if you do not accept the changes.
• We reserve the right to terminate a membership immediately and without refund if a member violates these Terms, attempts to abuse the system, or engages in fraudulent activity.

All original designs, STL files, artwork, branding, website content and code are the intellectual property of Comic Forge and are protected under the Copyright Act 98 of 1978 and applicable international copyright treaties.

• You may not copy, reproduce, distribute, modify or commercially exploit any Comic Forge content without prior written consent.
• Products featuring third-party characters or IP are sold for personal use only as fan art. Comic Forge makes no claim of ownership over such characters or properties.
• By submitting design files for custom printing, you warrant that you own the IP or have the legal right to use it, and you indemnify Comic Forge against all claims, costs and damages arising from any IP infringement related to your submitted files.
• Comic Forge will respond to valid DMCA / copyright infringement notices and will remove infringing content promptly.

The following are strictly prohibited and will result in immediate account termination, order cancellation and potential legal action:

• Using the website for any unlawful purpose or in violation of any South African law or regulation.
• Attempting to gain unauthorised access to our systems, accounts, or payment infrastructure.
• Submitting false personal information, using another person's identity, or creating accounts with fraudulent intent.
• Using automated bots, scrapers or scripts to access our website without permission.
• Attempting to manipulate pricing through exploits, bugs or unauthorised discount codes.
• Harassing, threatening or abusing our staff or other customers.
• Leaving false, defamatory or malicious reviews or making fraudulent complaints.
• Ordering products with the intention of disputing the charge after receipt (friendly fraud).
• Submitting custom print requests for weapons, illegal items, or content that violates any law.

To the maximum extent permitted by South African law:

• Comic Forge's total liability to you for any claim arising from these Terms or your use of our services is limited to the value of the specific order or transaction giving rise to the claim.
• We are not liable for any indirect, consequential, incidental, special or punitive damages, loss of profit, loss of data or business interruption.
• 3D printed products are novelty and decorative items. They are not certified safety equipment and should not be used as such. We are not liable for injury, damage or loss resulting from misuse.
• Our products may contain small parts and are not suitable for children under 3 years of age.
• We are not responsible for compatibility of digital files with your specific printer, software or settings.
• Nothing in these Terms limits liability for death or personal injury caused by our proven negligence, or for fraud or fraudulent misrepresentation.

• These Terms are governed exclusively by the laws of the Republic of South Africa.
• Any disputes arising from these Terms or your use of our services must first be submitted to us in writing at support@comicforge.co.za. We will endeavour to resolve disputes within 10 business days.
• If a dispute cannot be resolved amicably, it shall be referred to mediation before any court proceedings are initiated.
• You consent to the jurisdiction of the South African courts for any dispute that cannot be resolved through mediation.
• In the event of legal proceedings, the prevailing party is entitled to recover reasonable legal costs from the other party.
• Consumer complaints may also be lodged with the National Consumer Commission (NCC) at www.thencc.org.za.

Comic Forge processes your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Our Information Officer is responsible for ensuring compliance.

• We collect only the personal information necessary to process your orders, provide customer support, and improve our services.
• Your information will not be sold, rented or disclosed to third parties except as required to fulfil your order (e.g. courier services, payment processors) or as required by law.
• Payment card details are processed exclusively by our PCI-DSS compliant payment partners. We do not store card information.
• You have the right to access, correct, object to or request deletion of your personal information held by us. Submit requests to support@comicforge.co.za.
• We use cookies and analytics tools to improve website performance. By using the site you consent to this.
• Marketing communications will only be sent if you have opted in. You may unsubscribe at any time via the link in any marketing email.
• In the event of a data breach that may affect your rights, we will notify you as required by POPIA within a reasonable timeframe.
